Terms and Conditions for DAY TRIPS

(For Private and Custom Tours, Bucks, Hens, please read the next paragraph further down the page below titled Private Tours, Bucks and Hens ).

The Barrel Run Custom Tours is run by an accredited bus operator, entity ABN: 61868956257.

1.1: By making a booking for a distillery, winery and/or brewery tour with The Barrel Run Custom Tours you are agreeing to the Terms and Conditions set out in the schedule, and agree to abide by them as if they were a binding contract without alteration. Noting that the Agent is responsible for conveying these terms and conditions to all parties partaking in the event.

1.2:  The Barrel Run Custom Tours has the right at any time to alter the conditions of their terms and conditions at any time, and it is the client’s responsibility to ensure that they are aware of the conditions.

1.3: A version of the latest terms and conditions in relation to our company will be readily available at www.thebarrelrun.com.au, which will include the most up-to-date version.

 

Definitions:

1.4: ‘We’, ‘us’ or ‘our’ refers to The Barrel Run Custom Tours.

1.5: ‘Guest’ means a person who is aged 18 years or older who has made the booking and paid for the relevant tour.

1.6: We reserve the right to at any time increase or decrease the advertised tours and/or the prices of any of our tours.

1.7 Bookings and Confirmation

       a) In order to be booked on the tour you must receive a confirmation email from your enquiry, if you don’t receive one then you’re not booked on the tour.

        b) Upon receiving confirmation of your tour booking, a minimum 20% deposit is payable within 14 days of your tour, to The Barrel Run Custom Tours. We will issue you a receipt upon any payment. Please allow 3 business days for funds to clear.

        c) Confirmation of your booking must be complete 7 days before the booking by FULL PAYMENT to The Barrel Run Custom Tours. We will issue you a receipt upon payment. Please allow 3 business days for funds to clear.

1.8 All Prices are quoted in Australian dollars (AUD) and include GST.

1.9 Any extra drinks or food not listed in the inclusions will need to be paid for by the guest’s or third party (organiser of the group booking).

2.0 If you miss the tour on the day no refund will be given.

2.1  In the event that the schedule needs to be altered by The Barrel Run Custom Tours, an alternative venue will be sought at no extra cost to the customer.

2.2  All pricing found on our website supplants any previously advertised pricing.

Cancellations or Changes by Guest

2.3 If for any reason you need to cancel your tour, please notify Jaie at The Barrel Run Custom Tours as soon as possible via phone: 0424557091 or alternatively via email: customtours@thebarrelrun.com.au

2.4  If you need to cancel due to a Covid-19 lockdown, a positive Covid test or any issue Covid related, a credit will be issued for a later date within a 1-year period or please refer to our refund policy.

2.5: Refunds will not be issued except in accordance with these Terms and Conditions or as agreed by The Barrel Run Custom Tours only.

Cancellation and Refund policy is as follows:

·      a) Bookings will be confirmed via return email 7 days prior to the booking.

       b) Cancellations 7 days prior will receive an 100% refund.

       c) 80% refund will apply for cancellations within 1 week of the tour date.

       d) The Barrel Run Custom Tours will issue no refund for less than 24 hours cancellation before the tour date, 'no shows' or no notice of cancellation.

       f) Cancellations by The Barrel Run Custom Tours will result in 100% refund. 

     

2.6 The Barrel Run Custom Tours reserves the right to cancel or change tours due to operation and circumstances beyond our control (see cancellation policy above).

·     

2.7 We operate tours in working breweries, distilleries and wineries; however, we cannot guarantee that all elements of the brewing process will be operating at the time of the tour/s. 

2.8 All of our tours require a minimum of (4) guests to commence, if the minimum amount is not reached, we reserve the right to change or cancel any booking.

2.9 All fares and prices are valid from 1st November 2021 – 31/12/ 2022 All prices are shown in Australian Dollars, include GST and may be subject to change.

3.0 In the event of extreme weather that makes it impossible to carry out the activity safely, an alternative activity may be given and if one alternative is not suitable then cancellation will occur and a refund will be given.

– If we cancel a tour, we will endeavour to do one of the following:

– Rebook you for another date or tour (Subject to availability).

– Transfer your booking to another person.

– Refund your payment.

3.1 Last Minute Deals or Special Events

·      Prices are set as per person per tour and are subject to availability (Discounts may apply to selected tours only).

·      The Barrel Run Custom Tours reserve the right to discontinue the promotion at any time without notice.

·      From time-to-time discounted tours may be offered by us as last-minute deals.

·      Any discount does not apply to existing bookings and cannot be used with any other discounts.

·      The number of places on discounted tours is subject to availability.

3.2 Disabilities

The Barrel Run Custom Tours transportation is not equipped for wheelchair access and we are unable to personally care for individuals with special needs including disability. Persons attending the tour must be independent or have a carer in attendance to support the individual with their needs. We are happy to discuss this further (please phone with your enquiries).

3.3 Service of Alcohol

       a) The Barrel Run Custom Tours and associated venues do not condone excessive drinking or binge drinking and promote the responsible service of alcohol.

       b) All guests must abide by all state and federal laws regarding lawful drinking practices including but not limited to, Responsible Service of Alcohol (RSA) laws, the consumption of alcohol in public places, in-vehicle consumption of ‘bring your own’ (BYO) alcohol.

     

       c) Any guest who consumes, or is suspected of consuming alcohol in a non-licensed area, including on our tour bus,  will be removed from the tour, and will not be entitled to any refund.

 

       d) Service of alcohol may be refused to persons deemed intoxicated as per the Responsible Service of Alcohol (RSA) act by the venue.

 

       e) As The Barrel Run Custom Tours visits licensed premises where alcohol is served it is your responsibility to carry a valid passport, driver’s license, proof of age card, or another suitable form of identification and age verification. You must produce this willingly when requested.

·     

        f)  Any alcohol purchased on the Tour is to remain on the bus and may not be taken into the breweries.

 

3.4 Behaviour

·      a) You are responsible for your own behaviour.

·      b) Uncontrollable and disruptive behaviour will not be tolerated.

·      c) Any legal action (including fines) taken against a person on the tour, or against The Barrel Run Custom Tours because of actions due to a guest, will be the sole responsibility of the guest alone.

       d) We are not responsible for the behaviour of any third party, venues, providers or patrons outside of our tour.

3.5 We highly recommend you do not to drive after engaging in one of our tours and to arrange alternative transport. It is against the law to drink and drive. The Blood Alcohol Concentrate (BAC) in NSW, Australia is 0.05.

3.6 Guests are solely responsible for any damages incurred at any of the premises we visit, and to the property of The Barrel Run Custom Tours.

3.7 Sexual harassment of any kind, towards anyone will strictly not be tolerated.

3.8 Violence, threats or aggression will not be tolerated and you will be removed from the tour for this behaviour.

 

3.9 A minimum fee of $100 will occur in the event there is large amounts of spillage or vomit on any of our tours.

4.0 Smoking is not permitted on any of our transport.

·     

4.1 When sitting on our tour as a passenger, the seat belt must be worn at all times.

·     All passengers are required by Australian law to wear seat belts at all times as a passenger on a tourist bus.

 

4.2· Lost Property:

        a)In the event you have lost property on one of our tours we will attempt to contact you straight away, however if you notice that you have lost something please contact us immediately so we can search lost property, we will hold the item/s for a period of 3 months.

        b) Personal Belongings, whilst every care is taken, we accept no responsibility for belongings left unattended in the vehicle, left at a venue or otherwise misplaced.

4.3 Timing and Itinerary

      a) Departure, you must be 10 minutes early as the bus needs to keep a tight schedule for the pickup run.

·      We will not offer reimbursement or partial reimbursement in the event that a guest has failed to meet us at one of our pick-up points at the agreed time. 

·      b) We are not responsible for the late arrival to a venue on one of our tours.

·      c)We reserve the right to change a route or itinerary, inclusions, amend times, days and fares for its tours if necessary or withdraw without notice (see refund policy).

 

4.4 Publicity

·       a) Images and video footage may be taken by The Barrel Run Custom Tours throughout our tours and may be used on our website for publicity purposes by The Barrel Run Custom Tours.

        b) Patrons must identify themselves if they do not wish to be photographed/filmed and remove themselves from view when photographs or filming is announced by the operator.

         c) We may also share the content on social media platforms if required.

·            By engaging in our tours, you agree for this to occur.

4.5 Privacy

·     a) The Barrel Run Custom Tours will need to collect information from you some of which may be of a personal nature, in order to provide a service to you.

·      b) Information may be disclosed to, or collected on behalf of our service providers, and will not be used for any other service.

 

4.6 Guest Release and The Barrel Run Custom Tours Liability

·      a) Each guest releases The Barrel Run Custom Tours, it’s employees and agents from liability, loss or injury to the client from any cause, and whether due to the negligence of any other person or The Barrel Run Custom Tours

       b) Each guest releases The Barrel Run Custom Tours all sums of money, accounts, claims, actions, proceedings, demands and expenses which the client at any time may have against for or by reason or in respect of any act, cause, matter or thing.

·      Each guest indemnifies The Barrel Run Custom Tours Against:

·      All losses incurred by The Barrel Run Custom Tours

·      All liabilities incurred by The Barrel Run Custom Tours

·      All costs actually payable by  The Barrel Run Custom Tours its own legal representatives (whether or not subject to a costs agreement) and other expenses incurred by The Barrel Run Custom Tours in connection with a demand, action, arbitration or other proceedings (including mediation, compromise, out of court settlement or appeal); as a result of or in connection with any act or omission of the client.

·     

4.7 We recommend all travellers have adequate travel insurance in the event of delay, illness and loss of property which may result in failure to join or complete our tour.

 

4.8 The Barrel Run Custom Tours Discretion

·       The Barrel Run Custom Tours use its absolute discretion in exercising any of the rights granted to it pursuant to these Terms and Conditions.

 

4.9 Governing Law and Jurisdiction

·      The laws of NSW governs these standard Terms and Conditions. The Parties submit to the non-exclusive jurisdiction of the courts of NSW and of the Commonwealth of Australia

 

5.0 Force Majeure

·      Force Majeure, Except where otherwise expressly stated in these booking conditions, we regret we will not accept liability or pay any compensation where the performance or prompt performance of our obligations under our contract with you is prevented or affected by or you otherwise suffer any damage, loss or expense of any nature as a result of “force majeure”. In these booking conditions, “force majeure” means any event, or the consequences of which, we or the supplier of the service(s) in question could not, even with all due care, foresee or avoid. Such events are not limited to but may include actual or threatened war, riot, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, volcanic activity, seismic activity, fire, pandemics, epidemics and all similar events, natural or manmade, outside our control or that of our agents or suppliers.

 

Terms and Conditions for Private Groups, Bucks and Hens parties.

 

In addition to our Day Tours Terms and Conditions, the following alterations and additions will apply for any Private Group event, Customised Tours or Hen's/ Buck's Parties.

Customised and Private Group Tours for Special Event's book out our bus. The minimum cost for this booking at 11 persons is at the discounted price per head @ $159, which is equal to $1,729.00 plus $159 per person thereafter. For large bookings The Barrel Run Custom Tours reserves the right to alter this fee accordingly.

1.0 Charters & Private Tours

 The Barrel Run Custom Tours are available for private tours and special events (please contact us for more information).

       a) Private tours/charters require a deposit of 10% within 7 days of the booking, this is non- refundable in the case of cancellation but serves as payment towards the total cost.

·      b) Dates and activities are not guaranteed until the deposit is received.

·      c) If a booking is cancelled, please refer to our cancellations and refund policy for Private Groups, Buck's and Hen's parties.

·      d) Bucks and Hens tours incur an ADDITIONAL $100 bond, noting the bond will be returned three (3) business days after the tour has finished, providing the following:

– The Bus is left clean and free from damage.

– There is no negative feedback from the breweries, distilleries or wineries.

– Nothing was stolen or damaged at any visited venues.

1.1 By making a booking for a tour with The Barrel Run Custom Tours you are agreeing to the Terms and Conditions set out in the schedule, and agree to abide by them as if they were a binding contract without alteration. Noting that the Agent is responsible for conveying these terms and conditions to all parties partaking in the event.

1.2 The Barrel Run Custom Tours reserves the right at any time to alter the conditions of their terms and conditions at any time, and it is the client’s responsibility to ensure that they are aware of the conditions.

1.3 Payment, Pricing & Deposits:

       a) A 10% non-refundable fee is required within 7 days of receiving confirmation of your booking by email from The Barrel Run Custom Tours. This fee will be kept in the instance of any cancellation.

 

For HEN'S AND BUCK'S tours, an additional bond of $100 is due upon booking and will be refunded as per the conditions listed in item 1.0. 

 b) 100%balance is due 14 days prior to tour start date.

 

1.4 We reserve the right to at any time increase or decrease the advertised prices in relation to our tours.

1.5 Bookings are not final unless you have paid the deposit and where applicable the $100 bond and  there is confirmation via email from The Barrel Run Custom Tours.

1.6 Our Cancellation and Refund policy is as follows:

·      a) In regards to 7 days or less there will be a 80% refund.

·      b) If you or your third party purchaser cancel your booking 8-14 days before tour we will issue a 90% refund of the full payment including the deposit. 

·      c) In the event a cancellation is to occur before 14 days before the tour a full refund will be issued, less the non-refundable fee.

        d) If you need to cancel due to a Covid-19 lockdown, sickness or any issue Covid related, a credit can be issued for a later date within a 1-year period.

        e) Custom tours will only be transferrable with the written consent of The Barrel Run Custom Tours only.

        f) Refunds will not be issued except in accordance with these Terms and Conditions or as agreed in writing by The Barrel Run Custom Tours

1.7 Cancellation or Changes made by ‘us’

       a) The Barrel Run Custom Tours reserves the right to cancel or change tours due to operation and circumstances beyond our control.

        b) A full refund including the non- refundable deposit will be issued if we cancel the Private Tour.

· 

1.8 We operate tours in working breweries, distilleries and wineries; however, we cannot guarantee that all elements of the brewing process will be operating at the time of the tour/s.

1.9 All Private Tours require a minimum of (2) guests to commence with the cost representing the booking of the entire bus at a minimum of 11 persons, out of the 13 seats. If the minimum amount is not reached, we reserve the right to change or cancel any booking.

2.0 In the event of extreme weather that makes it impossible to carry out the activity safely, an alternative activity may be given and if one alternative is not suitable then cancellation will occur and a refund will be given.
